The Delhi High Court, while emphasizing gender equality within the armed forces, asserted on Tuesday that if a female officer can be stationed in Siachen, then it is equally permissible for a male to assume the role of a nurse in the military.
The bench, presided over by Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula, was deliberating a petition challenging the purportedly unconstitutional practice of exclusively appointing female nurses in military institutions.
Additional Solicitor General Aishwarya Bhati, representing the Central Government, contended that these military practices are rooted in longstanding traditions. Nevertheless, she noted that the government has recently introduced legislation in the Lok Sabha and state legislatures, mandating a 33% reservation for women.
The bench made an observation, stating, “On one hand, there is discourse about empowering women in Parliament; on the other hand, the stance is taken that a male cannot be designated as a nurse. If a female officer can be stationed in Siachen, then a male can certainly serve as a nurse in an Army hospital.”
Furthermore, the bench underscored that the Supreme Court has granted women access to the National Defence Academy (NDA) and consistently emphasized the absence of gender bias in service. Bhati apprised the bench that the Central Government has submitted its response in this matter.
Amit George, the counsel for the ‘Indian Professional Nurses Association,’ argued in the petition that India boasts numerous trained and qualified male nurses, and their exclusion from the military nursing corps is both “inappropriate and unconstitutional,” as it denies them employment and professional progression opportunities.
The petition, presented through counsels George and Rishabh Dheer, additionally posited that this practice obstructs the military and the nation from accessing dedicated professionals.
